REGULATIONS FOR PARTICIPATION IN ARTISTIC EVENTS
ORGANIZED BY Fundacja Tango Milonga
related to counteracting COVID-19
§ 1 General provisions
These regulations (hereinafter referred to as the "Terms and Conditions" or "T&C") contain special rules for participation as artists-performers (hereinafter referred to as "Artists") in artistic events (hereinafter referred to as "Events") organized by Fundacja Tango Milonga, registered at KRS under the number: 0000879003 (hereinafter referred to as the "Organizer") and constitutes an agreement within the meaning of Art. 384 of the Civil Code.
The Terms & Conditions are introduced to implement the Guidelines for organizers of cultural and entertainment events during the SARS-CoV-2 virus epidemic in Poland, issued by the Ministry of Culture and National Heritage, the Ministry of Development and the Chief Sanitary Inspector, available at https://www.gov.pl/web/culture/guidelines-for-organizers-cultural-and entertainment-events-during-virus-epidemi-sars-cov-2-in-poland.
Attachments to these T&C's are: Statements and Procedure for the implementation of the sanitary safety policy.
The T&C's and Appendices are made available to each Artist participating in a given Event in advance and each Artist is required to read them and fill in an appropriate statement on reading them and other documents implemented in connection with sanitary safety and a statement on their health. Failure to accept the Terms & Conditions and other documents, and failure to complete the statement on the state of health will prevent access to the area where the Event is taking place.
The events take place in the theater or in any other place designated by the Organizer, hereinafter referred to as the "Theater".
The name, date and place of a specific Event are specified in the Statement attached to these Terms & Conditions.
The Terms & Conditions, together with the Appendices, are also posted in the Theater so that each Artist can view them also during the Event.
The Participant of the Event is obliged to comply with the rules of order in force at the Theater, related in particular to logistics and security on the premises of the Event, as well as to follow the guidelines of the Organizer's employees.
The Organizer's employees are entitled to prevent participation in the Event or to ask a person who does not comply with the Terms & Conditions and/or Attachments or guidelines on the part of the Organizer's employees servicing the Event to leave the Theater.
§ 2 Organization of Events
Events organized by the Organizer are artistic events and are video recorded and may be transmitted using the Organizer's social media channels.
These events are private in nature, for which prior registration is required.
The registration can be made electronically by filling in a form. To register for workshops or Event in this way, you need an end device with access to the Internet, a Google Chrome web browser and an active e-mail account.
Only Artists who send the registration form to the Organizer and pay the appropriate fee in accordance with the price list available at www.quieroverte.com.pl have the right to participate in individual events of the Event.
The registration is only valid if confirmed by Organizer via email including a registration code.
Bank transfers should be described only with the code - the registration number stated on the confirmation email from the Organiser.
The Artist, using the electronic form of concluding an agreement with the Organizer, receives the Regulations along with attachments in the form of an e-mail and guidelines regarding payment for participation in the Event as an Artist.
To participate in the Event as an Artist, you must pay the so-called entry fee in the amount stated according to the price list indicated by the Organizer. Artists will receive information on how to pay the entry fee by e-mail after submitting the application and confirming the availability of the place. All prices are gross prices, expressed in Polish zlotys and Euro.
The number of people who can participate in the event as an Artist and stay at the Theater is strictly limited - there is a limit of people in accordance with the guidelines of the Ministry of Culture and National Heritage, and the Ministry of Development and the Chief Sanitary Inspector. After reaching the limit of people, the registration will be closed.
The procedure for admitting Event participants to the premises of the Theater will begin 60 minutes before the scheduled start of the Event.
At the entrance, keep a distance of not less than 1.5 m from other people in the queue to the entrance or exit.
A late person will not be allowed to enter the Event area.
You must show your ID upon entry to confirm your listing.
The artist, in accordance with Art. 38 sec. 12 of the Consumer Law Act, has no right to withdraw from the contract for the provision of services related to leisure, entertainment, sports and cultural events, if the contract indicates the day or period of service provision - due to the fact that the Event is of an artistic, and therefore cultural, nature, and the Statement indicates the date when a specific event takes place, the Artist is not entitled to withdraw from the contract.
The area where the Events are held is privately owned and cannot be considered a public space or a generally accessible place. Only persons who meet the criteria resulting from the Regulations, i.e. only previously registered Artists, may stay in this area at certain times. It is forbidden for third parties, regardless of the entity they represent, to move around the premises of the Theater. In the event of a disruption to the work of the Artists or the Organizer's employees, appropriate services will be called immediately with information about obstruction of the work that may be considered harassment by third parties.
The Organizer declares that, for safety reasons, in the event of the intrusion of third parties who are not the Artists or their legal guardians or parents, the Organizer's employees, the area of the Theater will be recorded in the form of audio and video using devices such as a mobile phone, camera, etc., and the recorded materials may be made available to external entities in the event of a security breach or as a result of financial arrears, which will serve as evidence in the event of legal disputes. Materials that will not be used in legal disputes will be each time removed within 14 days from their fixation. It is only a preventive action in order to ensure the highest quality of the organized event.
§ 3 Security measures
Only a person who, to the best of his knowledge, is not a person infected with the SARS-CoV-2 virus, is not in quarantine or under epidemiological supervision, is eligible to participate in the Event. Before entering the Theater, each Artist is required to submit a written statement (hereinafter referred to as the "Statement") that, to the best of his knowledge, he is not a person infected with the SARS-CoV-2 virus and is not under quarantine or under epidemiological supervision.
If a given person does not meet the requirements specified in sec. 1, refuses to submit a Statement, or if the Statement made by such a person in advance is no longer valid until such person enters the Theater in connection with the Event, such person is obliged to refrain from participating in the Event and will not be allowed to participate in the Event.
In a common space (such as a corridor, cloakroom) - it is mandatory to cover the mouth and nose with a mask.
Before entering the stage and after leaving the stage, Artists should disinfect their hands.
On the premises of the Theater or in the space where the Events are organized, including when entering the Theater premises, entering the audience, taking seats, entering the stage and leaving the stage or the Theater, hygiene regulations and staff guidelines must be strictly observed; keep a distance of not less than 1.5 m from other people in the queue to enter or exit.
Each Artist is obliged to wash their hands with a disinfectant provided by the Organizers, in designated places, in particular when entering the Theater and stage or leaving these places.
Theater employees are entitled to prevent a person who does not comply with the rules referred to in the preceding sections from participating in the Event.
The organizer warned the participants about the obligation to cover their mouth and nose and encourages them to bring their own masks, and also provides masks at the entrance.
§ 4 Complaints
The Organizer does not provide after-sales services or guarantees.
The Artist may submit a complaint in writing or by e-mail if the Event is not carried out by the Organizer or is carried out contrary to the provisions of the Regulations and its attachments. The Organizer is liable to the Participant in accordance with the general rules of the Civil Code.
The complaint should include:
a) the advertiser's identity data,
b) the subject of the complaint and the period to which the complaint relates,
c) circumstances justifying the complaint,
d) the signature of the claimant - in the case of a complaint submitted in writing.
All complaints should be submitted in writing at the reception desk or by e-mail to the following address: email@example.com immediately, no later than within 14 days from the date of the event giving rise to the complaint. In the case of submitting a complaint by e-mail, the complaint should be sent from the e-mail address indicated in the registration card, otherwise it will not be considered.
The organizer replies to the complaint by e-mail to the e-mail address provided by the complainant or in writing to the address provided by the complainant within 30 days from the date of its receipt.
The organizer may leave the complaint unrecognized if:
a) the complaint concerns a matter explained in the Regulations or attachments. In this case, the response to the complaint contains a reference to the relevant document,
b) the complaint concerns an issue previously clarified in response to a previous complaint notification of a given Artist. In this case, the response to the complaint contains a reference to the relevant correspondence,
c) the complaint comes from a third party who does not have the appropriate authorization or power of attorney,
d) will be submitted after 14 days from the date of disclosure of the reasons for the complaint.
If the complaint does not meet the formal conditions referred to above, the Organizer calls the claimant to supplement it within no more than 7 days, together with an instruction that in the event of failure to complete the complaint within the prescribed period, the complaint will be left without consideration. The Organizer will immediately inform the claimant about the exercise of the right to leave the complaint unrecognized.
§ 5 Out-of-court ways of dealing with complaints and redress
Detailed information on the possibility for the Artist, who is a consumer, to use extrajudicial means of dealing with complaints and redress and the rules of access to these procedures are available at the offices and on the websites of poviat (municipal) consumer ombudsmen, social organizations whose statutory tasks include consumer protection, Provincial Inspectorates of the Trade Inspection and at the following internet addresses of the Office of Competition and Consumer Protection:

An artist who is a consumer has the following exemplary possibilities of using out-of-court complaint and redress procedures:
may apply to a permanent consumer arbitration court referred to in art. 37 of the Act of 15 December 2000 on the Trade Inspection (Journal of Laws of 2014, item 148, as amended), with a request to settle a dispute arising from the Agreement concluded with the ORGANIZER,
may apply to the voivodeship inspector of the Trade Inspection, pursuant to Art. 36 of the Act of December 15, 2000 on the Trade Inspection (Journal of Laws of 2014, item 148, as amended), with a request to initiate mediation proceedings regarding the amicable settlement of the dispute between him and the Organizer,
may obtain free assistance in resolving the dispute between him and the Organizer, also using the free assistance of a poviat (municipal) consumer ombudsman or a social organization whose statutory tasks include consumer protection (including the Consumer Federation, Association of Polish Consumers).
§ 6 Final provisions
The rules of participation in the Event or staying on the premises of the Event may be supplemented or changed at any time depending on the issued legal acts and new guidelines referred to in § 1 section 2. Each Artist will be notified in advance of any changes. This includes change of venues, timings of Events. All current information can be found on the website: www.quieroverte.com.pl.
Registration for participation in the Event is equivalent to expressing an irrevocable, indefinite consent to the publication of photos or audiovisual materials presenting the Participant on: Event websites, the Organizer, on social media accounts, official photographers and filmmakers of the Event, and their modification.
Registration for participation in the Event is equivalent to accepting these Terms & Conditions.
Smoking is strictly forbidden in all Event venues.
The organizer reserves the right to refuse booking and admission to any event of the Event at its own discretion, without giving a reason.
Invoices for participation in the Event will be issued upon the participant's request. If you are interested, please contact us by e-mail.
The organizer is not responsible for any unfortunate accidents during the Event.
The Organizer is not responsible for the destruction or loss of the Participants' property, as well as for damages caused by the Participant during the stay at the Event.
It is forbidden to record or otherwise record dance classes during the Event without obtaining the consent of the Organizer in writing or the consent of the teachers.
The Terms & Conditions apply from March 18, 2021 and remain in force until further notice.
